1. General information
These Terms and conditions apply to the use of the www.getnails.ro website and to orders placed through it.
Get Nails is a brand operated by Tiger Nails S.R.L. Full identification and contact details for the company are available on the Contact & Support page.
By placing an order, the customer confirms having read and accepted these Terms and conditions, in the version valid at the time the order was placed.
2. Terms used
Throughout these Terms and conditions:
· The Site – www.getnails.ro.
· The Seller – Tiger Nails S.R.L., the company that operates the Site and sells the products under the Get Nails brand.
· Get Nails – the brand under which Tiger Nails S.R.L. sells the products and operates the Site.
· The Customer – the natural or legal person who creates an account and/or places an order on the Site.
· The Consumer – the natural person who purchases products for personal use, outside their commercial, industrial, artisanal, or professional activity.
· Professional Buyer – the customer, natural or legal person, who purchases products for their professional or commercial activity.
· Order – the Customer's request to purchase the products selected through the Site.
· Sales contract – the contract concluded between the Seller and the Customer for the ordered products, under the conditions provided in these Terms and conditions.
· Products – the goods offered for sale through the Site.
3. Customer account
In order to place an order on www.getnails.ro , it is necessary to create a customer account.
The data provided when creating the account and placing orders must be correct, complete, real, belong to the customer, and be kept up to date.
The Seller is not liable for the consequences of providing incorrect, incomplete, unreal, or third-party data, nor for any loss of access to the account, its compromise, or unauthorized access by a third party, insofar as these situations are not attributable to the Seller.
The Customer is responsible for maintaining the confidentiality of their account access data and for all activities carried out through it.
4. Products and product information
Information regarding the characteristics, use, storage conditions, and warnings applicable to the products is presented on the site and, as applicable, on the packaging, label, or in the documents accompanying the product.
Product images are presented for informational purposes. There may be differences in color rendering depending on the device used.
Some products are intended exclusively for professional use. This is indicated on the product page and/or on the packaging.
Products must be used according to the purpose, instructions, warnings, and conditions of use and storage communicated for the respective product.
Get Nails may update packaging, labels, and product information without prior notice. These changes do not affect orders already registered.
5. Prices and promotions
The minimum order value on www.getnails.ro is 100 RON.
The applicable prices are those displayed on the site at the time of placing the order.
The total price of the order, as well as delivery costs and any other applicable costs, are displayed before finalizing the order.
Prices and offers may be changed before placing the order. Changes do not affect orders already registered.
Promotional campaigns, discounts, promotional codes, and special offers may have their own conditions, communicated separately.
In the event of an obvious technical error regarding the price, availability, or other essential product information, the Seller may cancel the order before dispatch, informing the customer and refunding the amounts paid, as applicable.
6. Placing and confirming orders
Orders are placed exclusively online at getnails.ro.
We do not take orders by phone, email, WhatsApp, or social media.
Before placing an order, the customer is responsible for verifying and correcting the entered data and for reviewing the products, quantities, delivery method, payment method, and total order value.
Placing an order represents the customer's request to purchase the selected products and implies the obligation to pay the displayed price.
After placing the order, the customer will receive an electronic confirmation regarding the registration of the order. This confirmation attests to the receipt of the order and does not represent its acceptance.
The sales contract is considered concluded when the Seller accepts the order by dispatching the products, confirmed by the dispatch notification sent to the customer.
In the event that an order cannot be accepted or fulfilled for objective reasons, such as lack of product availability or a technical error, the customer will be informed without delay, and any amount paid for products that will not be delivered will be refunded.
7. Purpose of purchase: personal use or professional activity
At the completion of the order, the customer must select the actual purpose of the purchase:
For professional activity
For personal use
The selection of the option must correspond to the actual purpose for which the purchase is made.
For a natural person, a purchase for personal use is a purchase made outside of their commercial, industrial, artisanal, or professional activity. A purchase for professional activity is one made in connection with their professional or commercial activity.
The applicable rights are determined according to the actual purpose of the purchase and the applicable legislation.
Legal entities do not have consumer status. Selecting the option „For personal use” does not change this status.
The Seller is not liable for the fact that the ordered or delivered products do not correspond to a special purpose for which they were not presented, recommended, or accepted by the Seller before the conclusion of the contract.
8. Payment and invoicing methods
The available payment methods are displayed during the order finalization process and may vary depending on the delivery country and the type of order.
For orders with delivery in Romania
You can choose one of the following payment methods:
Card payment
You pay online, directly when finalizing the order.
Cash on delivery
You pay upon receipt of the parcel.
Bank transfer
After placing the order, you will receive the proforma invoice and the necessary payment details via email. The order will be processed after payment confirmation.
For orders with international delivery
Payment is made by bank transfer, based on a proforma invoice sent via email.
For international orders, card payment is currently not available.
The prices displayed on the site include VAT, according to current legislation.
A fiscal invoice is issued for each order. For the correct issuance of the invoice, the customer is responsible for providing complete and correct billing information.
9. Delivery
Delivery in Romania
Orders placed on working days by 16:00 are normally shipped on the same day. Those placed after 16:00 are shipped on the next working day.
After dispatch, you will receive by e-mail or SMS the information necessary to track the parcel directly on cargus.ro.
During very busy periods, such as Black Friday or holidays, processing time may be longer.
The courier fee for orders delivered in Romania is 15 lei.
For orders over 400 lei, shipping is free.
International delivery
We deliver to all European Union countries where Get Nails is not represented by an authorized distributor.
After placing the order, we will send you via e-mail the estimated shipping cost, calculated by the courier company based on the weight and dimensions of the parcel.
Upon confirmation of the cost, we will send you the proforma invoice and payment details.
After payment confirmation, we process and ship the order.
In case a product is unavailable or situations arise that may affect the delivery time, the customer will be informed.
If no other delivery date has been agreed, the legal term provided by the applicable legislation shall apply.
For consumers, the risk of loss or damage to the products is transferred when the consumer or a third party designated by them, other than the carrier, enters into physical possession of the products.
10. Right of withdrawal and product returns
For orders placed for personal use, consumers benefit from the legal right of withdrawal, under the conditions presented on the Return and right of withdrawal page.
The conditions, term, and procedure for exercising the right of withdrawal, as well as the conditions regarding sealed products, the condition of products, and the refund of amounts are presented on the dedicated page.
RETURN AND RIGHT OF WITHDRAWAL
For orders placed for professional activity, the 14-day legal right of withdrawal does not apply.
11. Legal guarantee of conformity - purchases for personal use
For purchases for personal use, consumers benefit from the legal guarantee of conformity for the purchased goods.
The Seller is liable for any lack of conformity existing at the time of delivery and found within 2 years from delivery, under the conditions of the law.
Lack of conformity means, primarily, the situation in which the good does not correspond to the description, type, quantity, quality, functionality, compatibility, characteristics or other requirements provided in the contract or applicable to the good.
The fact that the product does not meet a personal preference that was not communicated in writing as a requirement of the purchase before purchase, or the fact that the problem arose as a result of improper use, handling or storage of the product, does not in itself constitute a lack of conformity.
In the event of a lack of conformity, the consumer benefits, under the conditions of the law, from bringing the good into conformity, from a proportional price reduction, or from the termination of the contract.
To bring the good into conformity, the consumer may choose between repair and replacement, under the conditions of the law.
If the lack of conformity is found within the first 30 calendar days from delivery, the consumer benefits from the replacement of the good, under the conditions of the law.
In the event of a lack of conformity, repair or replacement is carried out free of charge for the consumer, within a reasonable time that cannot exceed 15 calendar days, a term established by mutual agreement, in writing, under the conditions of the law.
If the repair or replacement is not performed under the conditions of the law, does not remedy the lack of conformity, is impossible, or the lack of conformity is sufficiently serious, the consumer may benefit, as appropriate, from a proportional reduction of the price or the termination of the contract, under the conditions of the law. Termination of the contract does not apply in the case of a minor lack of conformity.
To resolve a complaint regarding a lack of conformity, the Seller may request additional information, photographs, video materials, or the return of the product for verification, when this is necessary to establish the lack of conformity and the cause of the problem.
12. Purchases for professional purposes
The 14-day legal right of withdrawal and the legal guarantee of conformity applicable to consumers do not apply to orders placed for professional activity.
This applies regardless of whether the purchase is made by an individual or a legal entity, when the products are purchased for professional activity.
Apparent problems upon receipt of the parcel
The professional buyer must verify the products, quantities, and their condition immediately after receiving the parcel.
Any wrong product, missing product, visible damage, or other issue that can be found through ordinary inspection must be notified in writing to the Seller within a maximum of 48 hours from receiving the parcel.
The term begins from the date and time of receiving the parcel, regardless of when the buyer chooses to open or check it.
The notice must be sent in writing, exclusively through one of the following channels:

· the contact form available on the website;
· WhatsApp, at the official Get Nails number.
Complaints submitted by phone or through social media are not considered written notifications and do not replace the obligation to notify through one of the channels mentioned above.
For apparent issues reported after the 48-hour deadline has expired, the Seller may invoke the effects provided by the applicable legislation.
Hidden defects
For hidden defects of movable goods, the professional buyer must inform the Seller within 2 business days from their discovery.
When the defect appears gradually, the period begins to run from the day the buyer realizes the gravity and extent of the defect.
Failure to comply with the legal notification deadline may result in the forfeiture of the right to request the resolution of the sale, under the conditions of the Civil Code.
For hidden defects of movable goods, the legal warranty period is 1 year from the delivery of the good, within which the defect must occur, under the conditions of the Civil Code.
In the case of a hidden defect, the professional buyer may request, as the case may be, the removal of the defect, the replacement of the good, the corresponding reduction of the price, or the resolution of the sale, under the conditions of the Civil Code.
Potential commercial returns for orders placed for professional purposes, other than those regarding non-conforming products, may be accepted only with the prior agreement of the Seller.
13. Use of products
Get Nails products must be used according to the intended purpose, instructions, warnings, and the conditions of use and storage communicated for each product.
The Client is responsible for the proper use and storage of the products.
The Seller is not liable for issues resulting from the improper use, handling, or storage of the products, the modification of the product, or its use for purposes other than those for which it was intended, to the extent permitted by law.
14. Customer reviews
We offer customers the possibility to provide reviews for purchased products.
To verify that the reviews come from customers who have purchased the evaluated products, these are associated with customer accounts and, where applicable, with the corresponding orders.
Reviews are moderated based on objective criteria, such as: verification of the purchase of the evaluated product, illegal, offensive, irrelevant, defamatory, promotional, fake, duplicate content, or spam.
15. Use of artificial intelligence
In accordance with Regulation (EU) 2024/1689 on artificial intelligence (AI Act), the Seller informs users that it uses artificial intelligence-based tools in its commercial activity.
Some images and videos published by Get Nails may be created or modified, in whole or in part, with the help of artificial intelligence tools, for creative and promotional purposes. The products presented for sale are real, and the information regarding their characteristics and performance corresponds to the marketed products. Artificial intelligence is not used to intentionally modify the actual characteristics or performance of the products or to represent them in a false or misleading manner.
Where applicable, content generated or modified with the help of AI will be marked according to the applicable legislation.
16. Trademark and intellectual property
GET NAILS® is a European Union trademark registered under no. 019352114, owned by Tiger Nails S.R.L.
The GET NAILS® brand, the logo, visual identity elements, texts, photographs, video materials, graphics, design, and original content published by Get Nails on the site are protected by the applicable legislation regarding intellectual property and, where applicable, copyright.
The unauthorized taking, copying, reproduction, modification, adaptation, distribution, publishing, or use of the GET NAILS® brand, visual identity elements, or site content, including photographs, texts, video materials, graphics, and design elements, is strictly prohibited without the express and prior written consent of Tiger Nails S.R.L., except in cases permitted by law.
It is also forbidden to use the GET NAILS® brand or Get Nails visual identity elements on products, packaging, labels, or promotional materials that do not come from Get Nails, as well as presenting such products as Get Nails products.
Tiger Nails S.R.L. reserves the right to take all available legal measures in case of unauthorized use of its brand or content.
17. Functioning of the website
The Seller makes efforts for the information available on the site to be correct, complete, and updated.
The information on the site may, in certain situations, not be updated in real time or may contain unintentional errors. The Seller makes efforts to identify and correct them after discovery.
In the event that an error relevantly affects an order, price, product characteristics, or other essential elements of the contract, the Seller will inform the client and resolve the situation according to the applicable legislation.
Technical errors, temporary interruptions, or unavailability of certain functionalities may occur. The Seller may perform maintenance, updating, or improvement work on the site without being held responsible for potential losses or damages resulting from these situations.
18. Personal data processing
Personal data processing is carried out in accordance with applicable law and the Privacy Policy of Tiger Nails S.R.L.

19. Complaints and dispute resolution
For any issue related to an order, product, or service, please contact us to resolve the situation.
Consumers may use, under the conditions of the law, the Alternative Dispute Resolution (ADR) procedure managed by the National Authority for Consumer Protection.
Consumers may also address the National Authority for Consumer Protection (ANPC).
20. Force majeure
The Seller shall not be liable for the non-performance or delayed performance of obligations when caused by an event of force majeure or other external, unforeseeable circumstances independent of its will, in accordance with the law.
21. Governing law and dispute resolution
These Terms and Conditions are governed by Romanian law, without prejudice to the mandatory provisions applicable to consumers, including those applicable to consumers from other European Union Member States, when these are incident.
Any dispute shall be settled, as a priority, amicably.
In case amicable settlement is not possible, the dispute shall be settled by the competent courts according to applicable legislation.
22. Amendments to Terms and Conditions
The Seller may update or amend these Terms and Conditions to reflect changes in legislation, services offered, or the operation of the website.
The version applicable to an order is the one valid at the time of concluding the contract and cannot retroactively change the rights and obligations pertaining to an already concluded contract.

23. Final provisions
If a provision of these Terms and Conditions is declared invalid or unenforceable, the other provisions shall remain applicable, to the extent permitted by law.
